1.1 These terms and conditions (“Terms”) govern your access to and use of the websites, funnels and landing pages operated by BOWO Creative Inc. (“BOWO Creative”, “we”, “us”, “our”), including bowocreative.com and its subdomains (the “Site”), and your purchase or use of our programs, products, services and program materials (together, the “Offerings”).
1.2 By accessing or using the Site, or by purchasing or using any Offering, you accept these Terms in full. If you do not agree, you must not use the Site or the Offerings.
1.3 Our Privacy Policy and Results Disclaimer form part of these Terms.
1.4 Where you have signed a separate written services agreement with us, that agreement prevails over these Terms to the extent of any conflict.
2.1 The Site is owned and operated by BOWO Creative Inc., registered in Canada. We are a marketing agency serving the medical aesthetics industry.
2.2 General enquiries: hello@bowocreative.com
Registered address: 4711 Yonge Street
3.1 We may revise these Terms at any time. The revised version takes effect when posted, and the “Last updated” date will change.
3.2 Continued use after a revision constitutes acceptance. Changes do not vary any signed services agreement.
4.1 The Site and Offerings are intended for business use by persons aged 18 or over. By using them you confirm you are 18 or over and, where acting for a business, that you are authorized to bind it.
5.1 Copyright © 2026 BOWO Creative Inc. All rights reserved.
5.2 We own or are licensed to use all copyright, trade marks and other intellectual property in the Site, the Offerings and all program materials, including text, graphics, logos, video, audio, templates, frameworks, systems, methodologies, worksheets and training content.
5.3 “BOWO”, “BOWO CREATIVE” and “BB10X” are trade marks or trade names of BOWO Creative Inc.
5.4 All rights not expressly granted are reserved.
6.1 Subject to these Terms, you may view, print and cache pages for your own reference, stream audio and video we publish, and submit enquiries and forms we make available.
6.2 Unless you own the relevant rights, you must not: republish material from the Site; sell, copy, sub-licence, rent or lease it; exploit it commercially; redistribute it; edit or modify it; or remove any proprietary notice.
6.3 We may suspend or withdraw this licence at any time, and immediately without notice where we reasonably believe you have breached these Terms.
7.1 Licence. On full payment, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the relevant program materials for your own business use only, for the access period stated at purchase.
7.2 Restrictions. You must not share your login, resell, sub-licence, reproduce, distribute, publicly display, record, or create derivative works from program materials; use them to build a competing product or service; or share them with anyone outside your business without our written consent.
7.3 Payment. Fees, payment schedules and access periods are as stated at the point of purchase or in your signed agreement. Fees are exclusive of applicable taxes unless stated otherwise.
7.4 Failed or missed payments. We may suspend access where payment is overdue, and may charge reasonable costs of recovery.
7.5 Refunds and cancellation
7.5.1 Programs and digital materials. Because access is granted immediately and materials can be downloaded and retained, all fees for programs, digital products and program materials are non-refundable once access has been granted.
7.5.2 Services. Fees for services are non-refundable once the relevant services have been performed. Where you terminate an engagement before completion, you remain liable for (a) all fees for services performed up to the effective date of termination, including work in progress; (b) fees for the then-current billing period; and (c) any third-party costs we have committed on your behalf.
7.5.3 Advertising spend. Amounts paid to advertising platforms are paid to those platforms, not to us, and are not refundable by us in any circumstances.
7.5.4 Deposits and onboarding fees. Deposits, setup and onboarding fees are non-refundable once onboarding has commenced.
7.5.5 Where we terminate. If we terminate for convenience, we will refund prepaid fees for services not yet performed, pro rata.
7.5.6 Guarantee. Where a performance guarantee applies, the remedy is as set out in your signed services agreement, continued provision of services at no additional fee, and that is your sole and exclusive remedy. The guarantee does not entitle you to a refund.
7.5.7 This clause does not limit any right you have that cannot be excluded under applicable law.
7.6 Changes to materials. We may update, improve or withdraw program materials. Where we withdraw materials during a paid access period, we will provide reasonable substitute access or a pro-rata refund.
7.7 No guarantee of results. Your results depend on your market, your execution and factors outside our control.
8.1 You must not:
a. use the Site in any way that damages or impairs its performance, availability or accessibility; b. use the Site or Offerings for any unlawful, fraudulent, deceptive or harmful purpose; c. transmit or distribute malicious software of any kind; d. conduct systematic or automated data collection — including scraping, data mining, harvesting, or training or fine-tuning any machine learning or AI model on our content — without our express prior written consent; e. access the Site using any robot, spider or crawler, except for legitimate search engine indexing; f. attempt to gain unauthorized access to the Site or any connected system; g. use the Site to transmit unsolicited commercial communications; or h. impersonate any person or misrepresent your affiliation.
8.2 You must not use data collected from the Site — including contact details of our team, clients or other users — to contact anyone or for any direct marketing activity.
8.3 You must ensure all information you supply to us is true, accurate, current, complete and not misleading.
9.1 Where you provide us with a comment, photo, image, video, writing sample, testimonial, review, creative asset or other material (a “Submission”), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that Submission for the purpose of providing the Offerings and for our marketing.
9.2 Testimonials. Where you provide a testimonial or review, you consent to our publishing it, together with your first name, business name and likeness, on our Site, in advertising and in sales materials. You may withdraw this consent at any time by contacting us, and we will remove it from materials we control within a reasonable period.
9.3 You warrant that each Submission is yours or that you hold all necessary rights, and that it does not infringe any third party’s rights, breach any law, or contain any patient information or personal health information.
9.4 Do not send us patient or health information through our website, forms or general email. If an engagement requires it, we will provide a secure channel under the appropriate agreement. See §11.
9.5 Where you make a Submission publicly visible, it can be seen, collected and used by others. We are not responsible for that use.
9.6 We do not accept unsolicited business proposals or creative concepts. Any such material is received on a non-confidential basis.
10.1 Content on the Site and in our Offerings is general business and marketing information. It is not medical, legal, accounting, financial, tax or regulatory advice.
10.2 Clinics and practitioners remain solely responsible for the accuracy of their medical claims, their scope of practice, their patient care and privacy obligations, and their compliance with all advertising, licensing and regulatory requirements applicable to their profession and jurisdiction — including, where applicable, HIPAA and equivalent health privacy legislation.
10.3 You should obtain your own professional advice before acting on anything we publish.
11.1 Where we process personal information on your behalf in delivering services, you are the controller and we act on your documented instructions. That processing is governed by our signed services agreement and a Data Processing Agreement, not by these Terms.
11.2 Where you are a HIPAA covered entity and our services involve Protected Health Information, a Business Associate Agreement must be executed before we handle that information. We do not accept PHI without one in place.
11.3 You are responsible for obtaining all consents required from your patients or customers for the marketing activity we deliver on your behalf, and for the lawfulness of the instructions you give us.
11.4 See our Privacy Policy §16 for further detail.
12.1 Results described on the Site or in our Offerings — including booked consultations, revenue figures, return on advertising spend, and any comparison or model — are examples achieved by specific clients under specific conditions. They are not a promise, projection or guarantee of your results.
12.2 Performance depends on factors outside our control, including your market and competition, your pricing and treatment mix, your advertising budget, your consultation close rate, your team’s responsiveness, and the policies, costs and delivery of third-party advertising platforms.
12.3 All testimonials published are real, shared with permission, uncompensated, and not claimed to be typical.
12.4 Our full Results Disclaimer applies.
13.1 Nothing on the Site constitutes an offer capable of acceptance, a binding quotation, or a commitment to provide services.
13.2 Service descriptions on the Site — including BB10X — are marketing summaries, not a specification of what you will receive.
13.3 Any engagement is governed exclusively by a separate written services agreement signed by both parties. Where anything on the Site conflicts with that agreement, the signed agreement prevails.
13.4 Any performance guarantee referenced on the Site is subject to the qualifying criteria, minimum advertising spend, client obligations, defined metrics and other terms set out in that signed agreement.
14.1 Email and text message consent, frequency and opt-out are described in our Privacy Policy
14.2 Consent to receive text messages is not a condition of purchasing anything. Reply STOP to unsubscribe, HELP for assistance. Message and data rates may apply.
15.1 The Site may link to third-party sites and is delivered using third-party platforms. We do not control and are not responsible for them, and a link is not an endorsement.
15.2 The Site is not part of, affiliated with, or endorsed by Meta Platforms, Inc. or Google LLC. FACEBOOK, INSTAGRAM and META are trade marks of Meta Platforms, Inc. GOOGLE is a trade mark of Google LLC.
16.1 We use artificial intelligence and automated systems in parts of our Offerings and communications, including automated responses to enquiries.
16.2 Automated systems can produce errors, delays or incomplete responses. Information provided through an automated channel is not a substitute for written communication from a member of our team and does not vary any signed agreement.
16.3 Where an automated communication conflicts with a written communication from us, the written communication prevails.
17.1 The Site and Offerings are provided “as is” and “as available”. We do not warrant they will be uninterrupted, error-free, secure or free of viruses.
17.2 We may alter, suspend or discontinue all or part of the Site at any time without notice.
18.1 Nothing in these Terms will limit or exclude any liability for: death or personal injury resulting from negligence; fraud or fraudulent misrepresentation; or any liability that cannot be limited or excluded under applicable law.
18.2 These limitations apply to all liabilities arising in connection with these Terms, the Site or the Offerings, whether in contract, tort (including negligence), breach of statutory duty or otherwise.
18.3 We will not be liable for any business losses, including loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
18.4 We will not be liable for any loss or corruption of any data, database or software.
18.5 We will not be liable for any loss arising from an event outside our reasonable control, including the acts, omissions, policy changes, pricing changes, outages, classification decisions or account actions of any third-party advertising or technology platform.
18.6 Subject to 18.1, our total aggregate liability in connection with the Site will not exceed [CAD $5,000], and in connection with any paid Offering will not exceed the fees you paid us for that Offering in the [12] months preceding the claim.
19.1 You agree to indemnify us against all losses, damages, costs, liabilities and expenses (including reasonable legal fees) arising out of or in connection with: your breach of these Terms; your use of the Site or Offerings in breach of applicable law; any claim that a Submission infringes a third party’s rights; or any claim arising from instructions you gave us, including the lawfulness of marketing we delivered on your behalf.
20.1 Where you breach these Terms, or we reasonably suspect a breach, we may suspend or block your access, terminate your licence to program materials without refund, contact your internet service provider, and commence legal proceedings.
21.1 Governing law. These Terms are governed by the laws of the Province of ONTARIO and the federal laws of Canada applicable in that province. The parties submit to the exclusive jurisdiction of the courts of ONTARIO.
21.2 Severability. If any provision is invalid or unenforceable, the remainder continues in force and the provision will be modified to the minimum extent necessary to make it enforceable.
21.3 Entire agreement. These Terms, with our Privacy Policy and Results Disclaimer, are the entire agreement in relation to your use of the Site and Offerings, and supersede all previous agreements on that subject. This does not affect any signed services agreement.
21.4 No waiver. Failure or delay in enforcing any provision is not a waiver.
21.5 Assignment. We may assign or subcontract our rights and obligations. You may not without our written consent.
21.6 No third-party rights. These Terms are not intended to benefit or be enforceable by any third party.
21.7 Survival. Sections 5, 9, 10, 11, 12, 18, 19 and 21 survive termination.
21.8 Headings are for convenience only.
